Petition to Rescind GRANTED with ease
For some DUI clients the most important issue for them is the suspension of their license. By following these initial pointers, you may be able to lift the suspension on their license withother ever having to go to hearing.
- As soon as you are retained on the DUI, file a petition to rescind. Do not wait until the first court date. Even if the facts do not sound good, file the petition.
- If the client has a copy of the Notice of Summary Suspension and the Warnings to Motorist, review these documents with a fine tooth comb. Check the timing on each document (you could potentially get an agreed order to rescind where the time of warnings if after the time of the test/refusal or where the time of refusal is not listed).
- Once you appear in court, check that your client's copy of the documents listed above matches the copy in the court file (if the Officer made any amendments after tendering the copy to your client, you could get an agreed order to rescind).
