People v. AF
AF was travelling on the highway when his tire went flat, forcing him to travel on his rim until he was able to exit the highway and pull over to the side of the road.  Upon pulling over, he was approached by law enforcement who told him to put his keys and his cell phone on the roof of his vehicle.  We filed a motion to quash the arrest and suppress evidence based on the illegal seizure of the defendant and the unreasonable duration of the stop pursuant to case law.  The judge granted our motion, suppressing the Standardized Field Sobriety Tests, a portable breathe test, as well as a breathe test at the station that was well over the .08 legal limit in Illinois.  We anticipate this case will be dismissed on the next court date due to the state lacking evidence.
